Emilio De Capitani

Emilio De Capitani is a Former Official of the European Parliament (19852011) and Secretary of the European Parliament Civil Liberties Committee (LIBE 1998-2011). Previously (1971 to 1985) head of the Service in charge of legislative coordination for the Regional Government of Lombardy (Giunta Regionale). As ordinary EU Citizen, he has promoted some legal cases before CJEU dealing with Legislative and administrative Transparency (such as CaseT-540/15 on Legislative Trilogues, case T163/21 on accessibility of Council Working Groups preparatory documents, T-590/23 on EU legislative Transparency and T-146/25 together with Access Info and professor Paivi Leno Sandberg challenging the Commission internal decision limiting the scope of what should be considered “EU Document”). Emilio has also challenged the implementation in Germany of the EU Directive on the Passenger Name Record (PNR). A formal request for preliminary ruling before the Court of Justice (Case C-222/20) has followed and, after the decision on case C817/19 the implementation of the PNR in Germany has been decided.

Emilio is currently affiliated Professor at Scuola Superiore S.Anna (Pisa) and Former Lecturer-Visiting Professor at University l’Orientale (Naples) Università Statale in Milano (2015-2017) and the Queen Mary’s Law School (London – 2015-2018) and author of several articles dealing with Italian regional development and European Union evolution (notably on public policies linked to the transformation on the EU in a freedom, Security and Justice area -art. 3.2 TEU).
